Bakuun.com outlines with the following document the relationship between the "Site" and the "Customer"

The following terms and conditions and further amendments to be made to this will apply to all our online available services by any mobile device, by e-mail or by phone. When the customer enters our website and look at offers, using and / or any of the available applications through any platform herein defined as "Website", and / or by completing a reservation, he declares to have read, understood and accepted the terms and conditions set forth below including the Privacy Policy.

This content is owned by Bakuun.com as well as the online booking service including the site structure. They are both provided for your exclusive personal purpose for non-commercial aims governed by the terms and conditions set forth below.

1. Scope of the service offered

Bakuun.com Ltd (hereinafter referred as Bakuun.com) through its website provides an online platform that allows to advertise and reserve all types of accommodation facilities (e.g. hotel, resorts, motels, hostels and B & Bs).Visitors can make reservations on the website. By making a reservation through Bakuun.com, a direct contractual relationship is established and the reservation becomes binding if confirmed by Bakuun.com; such confirmation results from the authorization of the accommodation facility of the said reservation, too. This confirmation establishes a direct contractual relationship (binding in legal terms) with the accommodation facility where the booking was made. Starting from the above reservation, we will do exclusively as intermediaries between you and the accommodation facility, conveying to the facility all the details of the reservation and sending you an e-mail confirmation for and on behalf of the accommodation.

When we advertise on the website of the various accommodation facilities, we disclose information that they have provided to us. In all the accommodation facilities, an access to a control panel called "Express Extranet" is provided. With this panel, the accommodation facilities can fully take care of every change, variation or deletion of data that we have published on the "Site". The accommodation facilities are fully responsible for updating especially the rates or the availability of any information displayed within the corresponding data published in our website. Although our technical staff pays great attention to all the published information, we are unable to verify and ensure the accuracy, completeness and correctness of the information. We cannot be held responsible for errors in general (including obvious or typographical errors), any interruption (due to failures, temporary and / or partial renovations or maintenance of the website). Furthermore we are not responsible for publishing inaccurate information, misleading or false, untrue or missing data. Each accommodation facility is responsible at all times for the accuracy, completeness and correctness of their (descriptive) information, including rates and availability displayed on our website. In case of any problem, our Customer Service will provide all the support needed to help the guest and will always be the contact point between the Guest and the accommodation facility.

Bakuun.com does not assume any kind of responsibility and / or warranty in relation to the quality or the status of the accommodation facilities on the website. The accommodation facilities are classified on the site according to variable criteria such as location, reviews, categorization, etc. ... The default positioning is based on an automated procedure that can be updated or amended from time to time according to varying conditions described above.

Bakuun.com reserves sometimes the right to refuse customers or reservations (or exceptionally to cancel confirmed bookings) for any legal reason at its sole discretion without any obligation to give reasons for such refusal. Among the various reasons for the rejection of a particular reservation there may be violation of the Terms of Use, trade sanctions or economic, legal restrictions, fraud, suspected criminal activity, suspicious reservations, misleading or false information sent by the guest, problems with credit card, threats, rejection, lack of important information, insults to personnel, communications failure. For such situations, Bakuun.com has set up a list of potentially unreliable customers. To those people the use of the entire portal in its own name and / or under a false name will be denied.

2. Additional charges by the Hotel

Please note that all prices on the website refer exclusively to the room reservation of the accommodation facility, at the required dates of stay and the number of people, if not otherwise specified. The booking rates are indicated per room per night. Except where otherwise noted, Bakuun.com shows the rate on the Site, net of taxes and charges for services during the booking procedure. Without prejudice as noted below, the Guest will have the total price displayed before the confirmation. In the last page, it will be possible for the Guest to stop the booking at any time before the confirmation screen, according to the condition relating to the various cancellation cases that characterize the reservation.

The services included in the rate are displayed on the Site in the accommodation facility Form and are then summarized in the email confirmation of the booking. The staying fee, other compulsory taxes and some local taxes (if any) are not included in the price, except where indicated otherwise.

We never include in the quoted prices insurance of any kind. Reservations for standard rooms are for one or two people or as specified in the detail file. In case of additional people, an extra fee is usually charged.

In addition, the accommodation facility, where provided, may refuse to accept other people in the same room without an appropriate notice. Please note that in some cases the accommodation facility may charge a so-called "staying fee" or similar additional mandatory tax for the use of some services. This fee is not usually included in the prices listed on the site, but it is mentioned in the description of the facility in the website. The accommodation facility may charge it where applicable directly to the guest in the extra costs arising from factors such as extemporaneous energy consumption, tourist taxes, cleaning, luggage storage, newspapers, in-room safe etc. .... It is useful to bring to the guest’s attention that optional charges and personal consumption are almost never included, for example, room service, food and drinks, gala dinners, parking, mini bar, telephone calls, movie rental, Internet, etc.. Some accommodation facilities may need where requested the confirmation of the booking of any transfers from / to the facility required at time of booking. Bakuun.com does not organize any type of transfer / transport, all the service is managed and organized by the accommodation facility.

3. Currency Conversion

The currency converter is just for information purposes and it should not be considered as an accurate and real-time operating indicator; rates can vary.

The obvious mistakes are not binding, including printing mistakes.

All special and promotion offers are indicated as such.

4. Privacy and Cookies

Bakuun.com respects the privacy of its Guests according to the laws in force. Unless required by law in any relevant jurisdiction, and except for the transmission to the accommodation of your name, your e-mail address and the details of your credit card, the purpose of which is to complete the reservation for the selected facility, we will not disclose your personal information to third parties without your consent. However, we reserve the right to disclose your personal information within our support offices belonging / not belonging of the European Community, where our staff need to access in order to perform their tasks ranging from surveys to customer care and the creation of statistical reports used by our agents in their ordinary work, so that you can take advantage of a better service.

5. Free of charge Service

Our service is totally free and we will not charge nor for any offered service or for extra fee related to the reservation of the room rate. We will not charge on your credit card, as you will pay directly to the facility during your stay or before your stay in the cases where required by booking conditions. We always point out that we do not exercise ever charges under any circumstances stipulated in the conditions governing the rules of use of our Web Site.

6. Credit card or bank transfer

Most accommodation facilities require the credit card details in order to guarantee your reservation. Therefore, we will send the details of your credit card directly to the structure where the booking was made and we may verify its validity. In order to safeguard and encrypt your credit card information when in transit to us, we use the "Secure Socket Layer" (SSL). Moreover, in order to guarantee greater security, we specify that your data will be sent to the person in charge for the reception of the same at the accommodation facility. It could happen that, depending on the accommodation and depending on the type of room, that the facility may require the ability to make the payment for non-refundable bookings

during the booking process, through a secure online payment system (as long as your bank permits and supports operations of this kind). The payment transaction will be managed safely by a third party and the amount will be transferred directly from your bank account to the accommodation facility. Bakuun.com does not make, accept or handle in any way any payment to or for the account of the facility.

For certain (non-refundable) rates or special offers, you may be required to make payment by bank transfer (if indicated as method of payment from the facility), or credit card. In case of using the credit card, this could be pre-authorized or charged (sometimes without any option for refund) upon reservation and confirmation of the booking. Before making your booking, carefully check the presence of such conditions in the room details and rates.

In case of fraud or unauthorized use of your credit card by third parties, the Guest must contact the bank or institution that issued the card upon becoming aware of such use. If the Guest suspects an unauthorized booking or fraudulent by Bakuun.com, he should immediately contact the Customer Care of the Company. To make a booking, the Guest must be over the age of 18 (or the age of majority in the countries and territories where more than 18 years) and have full legal capacity to make the transaction (or he must have permission from the legal guardian). The Guest warrants that he owns the credit card or debit card used and that he has sufficient funds to cover the cost of the transaction. He accepts the financial responsibility for all transactions made under his name or on his behalf.

7. Cancellation

By making a reservation at an accommodation facility, you accept and approve the relevant rule of cancellation and no-shows of that facility and any other regulations or additional terms of the facility applicable to your reservation or during your stay, including services and / or products offered from facility (the rules and conditions are obtained directly from the facility of relevance). Cancellations or changes are not permitted for certain rates or special offers. Prior to booking, check carefully if such conditions are present in the room details and rates.

If you want to check, change or cancel your reservation, please access to your e-mail confirmation and follow the instructions contained therein. The facility may charge a fee in accordance with its relevant cancellation and no-show rules. 8. Special needs of the customer

In case of special requirements (e.g. room accessible for a wheelchair or other special requests) ,the Guest must enter this piece of information into a box during the booking confirmation and then if needed, he must contact our Customer Care Service or the accommodation facility to ensure that it can meet those needs. Please note that all special requests are subject to availability and cannot be guaranteed by Bakuun.com.

9. Sending communications to the Guest before and after booking

After you have made a reservation, you will receive an email confirmation containing information about your destination, various tips and special offers (even by third parties, if you have provided approval) relating to your booking and destination, and an e-mail after your stay with an invitation to write your comment on the structure. 10. Guest reviews

The Guest rating of the facility will be loaded on the page of the accommodation facility in our website in order to provide to the next clients an evaluation criteria on the structure you want to book. This judgment can be supplied by two different types of users such as social network user from which the future user of the services of the accommodation judged can have the opportunity to not only see the real judgment but he can also interact and ask for confirmations and / or denials on the information provided. The second type involves the evaluations provided by users who have also stayed in the structure but who cannot be identified and contacted through our internal social network. We reserve the right to edit, refuse or remove reviews at our sole discretion. The form for the judgment of the guest must be considered a survey and does not include any (further) offer, invitation or inducement (commercial) of any kind.

11. Disclaimer clause of liability

Subject to the limitations and the details provided in the circumstances set out in these terms and conditions and to the extent permitted by law, we shall be liable only for direct damages actually suffered, paid or to which you were getting into, due to a failure to observe our obligations in respect of the services that we would have to perform. The compensation may be up to the total cost of your reservation as set out in the e-mail confirmation (or for one event or series of connected events).

However neither we nor any of our managers, employees, representatives, affiliates, agents, or persons involved in the production, sponsorship, promotion or diffusion of the site and its contents, to the extent permitted by law, will be liable of losses for any direct / indirect or consequential, incidental, special, exemplary, compensatory, including but not limited due to (i) loss of production, profit, revenue, contract, loss of or damage to the fame or reputation, loss of complaint, business interruption, loss of data or other intangible losses, (ii) any inaccuracy of information (descriptive) of the accommodation facility (regarding the availability, rates, classification), made available on our Web site, (iii) for the products offered and / or services provided by the facility, (IV) for any direct, indirect, consequential or punitive damage, inability to use by the customer, unauthorized use, delay, malfunction and / or operation of the website, (V) for any personal injury, death, property damage or other types of damage (whether direct, indirect, special, consequential or punitive) losses or costs suffered, incurred or paid by you, for legal actions, violations of any kind, errors, major faults, willful misconduct, omissions, negligence, misrepresentation, or objective liability for an unlawful act attributable (partially or totally) the structure (its employees, directors, managers, agents), including cancellations, partial cancellation, overbooking, strike, force majeure or any other event beyond our control.

The responsibility of the operative Bakuun.com is excluded or limited to the maximum extent permitted by law. Without the limitations set out in the Terms of Use, the responsibility of the operative Bakuun.com never exceeds, and in no case the lesser of (I) the total cost of the reservation indicated in the reservation confirmation received by e-mail, regardless of which either a single or several related events (II) fifty.

The original text in English of these Terms and Conditions may have been translated into other languages. The translated version is unofficial, for illustrative purposes only, therefore null, and void. In case of dispute, inconsistency, or discrepancy between the English text and translations in other languagesof these Terms and Conditions, the English text shall prevail and will be the final version. The English version is available on our website (by selecting the English language) or will be sent upon written request. In the event that any of the clauses of these Terms and Conditions is invalid, lose validity, is or becomes non-binding, you will continue to abide by all other established clauses hereof. In that case, we will replace that clause with a valid and binding clause and with an effect as much as possible, similar to the one replaced and that you agree to accept in respect of the content and purposes of these Terms and Conditions.
